Introduction :

GlobalOutlook (henceforth referred to as “GO” or “Global Outlook”) offers Hosted Microsoft Communication Services that include Hosted Exchange, SharePoint and Collaboration tools to its customers. GO has created this Acceptable User Policy (“AUP”) to enhance the use of its services by preventing unacceptable use. By visiting this website and/or using or purchasing services from or through this website, you consent to the acceptable use practices described in this AUP. GO may suspend or terminate your use of the services if you or any of your employees or other users of the service violate this AUP.
 

Changes to This Policy :
GlobalOutlook may revise this AUP from time to time and at any time without notice by posting a new version of this document on this website. All revised or updated copies of the AUP are effective immediately upon posting. Accordingly customers and users of GlobalOutlook Services should regularly visit our website and review the AUP to ensure that their activities conform to the most recent version.
 

Products and Services :
Products and Services shall mean the <link> www.GlobalOutlook.com website and all GlobalOutlook software products and services, whether hosted on the website or available through a third party’s server, shall only be used as specifically provided for in this AUP. GlobalOutlook may modify or discontinue offering or supporting any or all of the Products and/or Services at any time, for any reason, without notice, and without liability to you or to any other party.
 

GlobalOutlook grants you a limited, non-exclusive and non-transferable right to use the Products and Services in accordance with this AUP. The Products and Services shall not be copied, distributed, duplicated, modified (whether or not such modification constitutes a derivative work), reproduced, sold, stored (including any portion of the software or documentation thereof), or otherwise exploited without the express written consent of GlobalOutlook. You shall not frame or utilize framing techniques to enclose any of GlobalOutlook’s intellectual property without the express written consent of GlobalOutlook.
 

GlobalOutlook grants you a limited, non-exclusive and non-transferable right to create a hypertext link to the home page of the website so long as the hypertext link does not portray GlobalOutlook in a derogatory, false, misleading, or otherwise in offensive manner. You may use GlobalOutlook’s service marks, trademarks or trade name in connection with the hyperlink, so long as the ownership of these service marks, trademarks or trade names is attributed by you to GlobalOutlook.
Use of the Products and Services requires a certain level of knowledge and familiarity with the Internet and World Wide Web. GlobalOutlook does not take any responsibility to provide free support to you for the use of the internet, World Wide Web and other Products and Services.
 

Representations and Warranty :

  1. Create or maintain software download or distribution sites or sites created for the purpose of mass distribution of software products. A software distribution site is defined as a site on which 50% or more of total bandwidth (data transfer) is used for programs or binary code downloads.
  2. Create or maintain sites that generate system errors or any such problems that disrupt servers' performance or cause server-wide outages. This includes overriding or avoiding system settings and restrictions imposed by the terms of Services.
  3. Create or maintain sites that consume thirty-five percent or more of CPU capacity or use two hundred megabytes of memory, both physical and virtual combined, on the hosting server.
  4. Exceed allowed bandwidth by transferring amounts of data greater than allowed by the terms of purchased Service.
  5. Violate any applicable laws, rules, regulations, guidelines or directions or other provisions having the force of law, either intentionally or unintentionally or knowingly or unknowingly.
  6. Impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity.
  7. Employ misleading e-mail addresses or falsify information in any part of any communication.
  8. Upload, transmit, disseminate, post, store or post links to any content that:
  9. Prohibited from transmitting or posting by any law, rules, regulations, guidelines or directions or other provisions having the force of law or by contractual or fiduciary relationship;
  10. Facilitates hacking or unauthorized access or use of data, systems, servers or networks including any attempt to probe, scan or test for vulnerabilities, or to breach security or authentication measures;
  11. Falsifies origin by forging TCP/IP packet headers, e-mail headers, or any part of a message header, unauthorized monitoring of data or traffic;
  12. Interferes with service to any user, system or network by using flooding techniques, overloading a system or a network, staging or broadcasting an attack, or any other means resulting in a crash of a host either deliberately or by negligence;
  13. Infringes or contributes to any infringement of any intellectual property, material protected by copyright, trademark, patent, trade secret or proprietary right of any person or entity;
  14. Is or may be considered unsolicited or unauthorized advertising, promotional materials, or any junk mail, Spam, Spam-vertisements, make money fast schemes, chain letters, pyramid schemes, or any other form of solicitation (for details please refer GlobalOutlook NO SPAM POLICY below);
  15. Contains viruses, worms, Trojan horses, time bombs, trap doors, or any other computer code, files, or programs, or files or repetitive requests for information designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;
  16. Is unlawful, harmful, threatening, abusive, harassing or tortuous, libelous or false, defamatory, vulgar, obscene, or of porno in nature or invasive of privacy;
  17. Promotes criminal activities of any kind including but not limited to terrorists activities or which may disrupt (in any way) the public peace, harmony or law and order of the State or a specific region or group(s).
  18. Is of adult nature, pornographic, or harmful to minors or promote in any way child pornography;
  19. Promotes illegal activity, including providing instructions for illegal activity, or transmitting, disseminating or offering fraudulent goods, services, schemes or promotions, or furnishing false data on any signup form, contract or online application or registration, or the fraudulent use of any information obtained through the use of the Services including use of credit card numbers.
  20. Exploits the images of children or discloses personally identifiable information belonging to children.

GlobalOutlook’s NO SPAM POLICY :
Reporting Spam
GlobalOutlook defines SPAM, also known as Unsolicited Commercial Email (UCE) or Unsolicited Bulk Email (UBE), as any email message the recipient considers unsolicited and of a commercial nature or email sent in bulk.
 

GlobalOutlook expressly prohibits the sending of SPAM through its network and servers.
 

If you believe that you have received SPAM (as defined above) or the victim of any Prohibited Email Activities (defined below) from GlobalOutlook's network, please send a signed complaint along with the message you received, including its complete email headers, to abuse@GlobalOutlook.com
 

GlobalOutlook does not investigate or take action based on anonymous SPAM complaints. All complaints will be processed by GlobalOutlook, in accordance with the GlobalOutlook Complaint Processing Procedure below.
 

Indemnification :
Customer agrees to indemnify, defend and hold harmless GlobalOutlook and each of their respective officers, directors, employees, shareholders, attorneys and agents (each an "indemnified party" and, collectively, "indemnified parties") from and against any and all claims, damages, losses, liabilities, suits, actions, demands, proceedings (whether legal or administrative), and expenses (including, but not limited to, reasonable attorney's fees) threatened, asserted, or filed by a third party against any of the indemnified parties arising out of or relating to Customer's use of the Services, (ii) any violation by Customer of the AUP, (iii) any breach of any representation, warranty or covenant of Customer contained in this Agreement or (iv) any acts or omissions of Customer. The terms of this section shall survive any termination of this Agreement.
 

Limited Warranty :

  1. GlobalOutlook represents and warrants to Customer that the Services will be performed (a) in a manner consistent with industry standards reasonably applicable to the performance thereof; (b) at least at the same level of service as provided by GLOBALOUTLOOK generally to its other customers for the same services; and (c) in compliance in all material respects with the applicable Service Descriptions. Customer will be deemed to have accepted such Services unless Customer notifies GLOBALOUTLOOK, in writing, within thirty (30) days after performance of any Services of any breach of the foregoing warranties. Customer's sole and exclusive remedy, and GLOBALOUTLOOK's sole obligation, for breach of the foregoing warranties shall be for GLOBALOUTLOOK, at its option, to re-perform the defective Services at no cost to Customer, or, in the event of interruptions to the Services caused by a breach of the foregoing warranties, issue Customer a credit in an amount equal to the current monthly service fees pro rated by the number of hours in which the Services have been interrupted. GLOBALOUTLOOK may provision the Services from any of its data centers and may from time to time re-provision the Services from different data centers.
  2. The foregoing warranties shall not apply to performance issues or defects in the Services (a) caused by factors outside of GLOBALOUTLOOK's reasonable control; (b) that resulted from any actions or inactions of Customer or any third parties; or (c) that resulted from Customer's equipment or any third-party equipment not within the sole control of GLOBALOUTLOOK. EXCEPT AS EXPRESSLY PROVIDED IN THIS SECTION, GLOBALOUTLOOK MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, WITH RESPECT TO THE SERVICES OR ANY SOFTWARE PROVIDED UNDER THIS AGREEMENT, INCLUDING, WITHOUT LIMITATION, ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE OR NON-INFRINGEMENT OF THIRD-PARTY RIGHTS, AND GLOBALOUTLOOK HEREBY EXPRESSLY DISCLAIMS THE SAME. WITHOUT LIMITING THE FOREGOING, ANY THIRD-PARTY SOFTWARE PROVIDED TO CUSTOMER HEREUNDER IS PROVIDED .AS IS. WITHOUT ANY CONDITION OR WARRANTY WHATSOEVER. GLOBALOUTLOOK DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE OR COMPLETELY SECURE.

Prohibited Email Activities

  1. Sending UCE/UBE, also known as SPAM:It is one of the most serious account abuses.

UCE/UBE or SPAM Response Collection:
Defined as the collection of responses, directly or indirectly, from UCE or UBE sent by you or UCE or UBE sent on your behalf.

  1. Web Site Advertising via UCE or UBE, also known as SPAMvertising: Defined as the sending of email which:

i. is UCE or UBE as defined above; and
ii. Contains direct or indirect links or references to one or more web sites.
This also includes the use of third-party email accounts, servers or services to SPAMvertise the site(s).

  1. Mail Bombing: Defined as the sending an unreasonably large number of electronic mail messages to a single system, person or email address.
  2. Mail Harassment: Defined as sending email in a manner or with content that is perceived as threatening or harassing or irritating by the intended or actual recipient.
  3. Letter Bombing: Defined as sending email with content that will or could potentially harm the recipient's computer.
  4. Viruses, worms, Trojan horses, time bombs, trap doors, or any other computer code, files, or programs, or Mala fide files or repetitive requests for information designed to interrupt, destroy or limit the functionality of any computer software or hardware.

GlobalOutlook Complaint Processing Procedure:
GlobalOutlook prohibits SPAMMING, defined as the sending of Unsolicited Commercial Email (UCE) and Unsolicited Bulk Email (UBE), in order to protect the integrity of the GlobalOutlook shared server and network resources.
 

Complaints of UCE and UBE, regardless of whether the email is actually solicited or not, are what trigger the blacklisting of GlobalOutlook networks and services. Therefore, the sending of email which results in UCE/UBE complaints is conclusively a SPAMMING activity in violation of GlobalOutlook's No SPAM Policy.

IT IS YOUR RESPONSIBILITY TO PREVENT ALL SPAM COMPLAINTS RESULTING FROM EMAIL ACTIVITIES ON YOUR GLOBALOUTLOOK HOSTED ACCOUNT.
 

Processing of Reports of SPAM Activity and SPAM Complaints
GlobalOutlook processes reports of SPAM activity and SPAM complaints in the manner described below.

 

  1. If the email activity associated with your hosted GlobalOutlook account poses an immediate threat to GlobalOutlook's servers or network, GlobalOutlook reserves the right to immediately disable the account and send email notice to your account contact. An immediate threat includes GlobalOutlook's receipt of ten or more SPAM complaints in a 72 hour period.
  2. Absent an immediate threat to the servers or network, GlobalOutlook will follow the steps outlined below for SPAM processing.
    1. First UCE/UBE Event – GlobalOutlook sends a "complaint received" message to the complainants and sends the complaints and first warning to your GlobalOutlook account contact.
    2. Second UCE/UBE Event – GlobalOutlook sends a "complaint received" message to the complainants and sends the complaints and second and final warning to your GlobalOutlook account contact.
    3. Third UCE/UBE Event – GlobalOutlook immediately disables the email capabilities of the account and then sends notice to your GlobalOutlook account contact of the permanent email disablement.

A UCE/UBE Event is defined as either of the following:

  • GlobalOutlook's receipt in any 72 hour period of 3 or more complaints or notices of activity on your account that violates GlobalOutlook's No SPAM Policy; or
  •  GlobalOutlook's receipt in any 30 day period of 6 or more complaints or notices of activity on your account that violates GlobalOutlook's No SPAM Policy
